Terms of use

This English version is provided for information. Only the German version is legally binding.

Which rules apply when creating posts?

  1. By creating a post, you declare that it contains no content that violates applicable law. In particular, you declare that you have the right to set or use the links and images used in your posts.
  2. Posts should inform objectively and must not offend common decency.
  3. The Society for Self-Sufficiency (GAIA) exercises the right to determine who may use its premises. In the event of violations of these rules, GAIA may, after a warning, exclude you temporarily or permanently from using the members’ area.
  4. You acknowledge that GAIA accepts no responsibility for the content of posts that it has not created itself or of which it has not taken note.
  5. You permit the GAIA editorial team to modify your posts if they violate the above rules or are likely to cause damage to GAIA or a third party.

Which further rules apply when writing comments and replies to comments?

  1. The comment function is available in the members’ area after logging in and is subject to approval. The author of a post that can be commented on may be made jointly responsible for approving comments. If they are no longer able to do so, the GAIA web team takes over approvals in its administrative function. Replies to comments are subject to the same rules as comments.
  2. While you comment, your IP address, email and username are recorded and stored permanently by the system. The IP address contains information about where you were at the time of commenting.
  3. Comments containing hostility, threats or other unobjective wording will not be approved. In the event of violations of these rules, the Society for Self-Sufficiency (GAIA) may exclude you temporarily or permanently from using the members’ area or terminate your membership.

Provisions on liability

  1. With the exception of injury to life, body and health and the breach of essential contractual obligations (cardinal obligations), the Society for Self-Sufficiency (GAIA) is only liable for damage caused by intentional or grossly negligent conduct. This also applies to indirect consequential damage, in particular loss of profit.
  2. Towards consumers, except in the case of intentional or grossly negligent conduct or damage resulting from injury to life, body and health and the breach of essential contractual obligations (cardinal obligations), liability is limited to the damage typically foreseeable at the time the contract was concluded and otherwise in amount to the average damage typical for the contract. This also applies to indirect consequential damage, in particular loss of profit.
  3. Towards entrepreneurs, except in the case of injury to life, body and health or intentional or grossly negligent conduct by the operator, liability is limited to the damage typically foreseeable at the time the contract was concluded and otherwise in amount to the average damage typical for the contract. This also applies to indirect damage, in particular loss of profit.
  4. The limitation of liability in paragraphs 1 to 3 also applies accordingly in favour of GAIA’s employees and vicarious agents.
  5. Claims for liability under mandatory national law remain unaffected.

Reservation of changes

  1. The Society for Self-Sufficiency (GAIA) is entitled to change these terms of use and the privacy policy. Members will be notified of changes by email.
  2. The member is entitled to object to the changes. In the event of an objection, the contractual relationship between GAIA and the member ends with immediate effect.
  3. The changes are deemed accepted and binding if the member does not object to them within one week of being sent them by email.
